TERMS OF SERVICE

Please kindly read carefully the Terms and Conditions between you and Sparkle By Design, LLC & SparkleByDesign.net Maui Yoga and Meditation Revitalizing Retreats and Maui B & B for all bookings. These terms and conditions apply equally to all participants of different nationalities. Your contract will be legislated by the justice of the United States of America in Washington State and otherwise necessary.Those who make their reservation must Accept the following Terms and Conditions.
1. General Terms of Booking and Payment
Payments – Your payments are Refundable for 7 Days from your Purchase On-line.
Our policy for Credit Cards and Data Privacy is set out in paragraph 14 and paragraphs 22.

The price is the exact amount to be received by us, irrespective of fluctuations in currency and irrespective of any third party transfer charges. If you choose to pay by electronic transfer, please instruct your bank to charge all costs to you in order to avoid a shortfall in the amount that we receive.Details for bank to bank transfer will be sent to you on request.
Sparkle By Design, LLC retreat reserves the right to offer discretionary discounts and this does not affect the status of any guests who have paid the full price and no discount will then become due to them.

2. Age and Gender
All genders are welcome. The minimum age of any participant is open unless otherwise agreed in writing, at our discretion. There is no maximum age. A person who attends that is under 18 years old or younger, especially children under 12, must have a Parent or Guardian with them at all times.If the Parent or Guardian attend any activity and cannot be present at all times with the child, we are not liable in any way.It would be strongly encouraged to hire a professional Nanny or Additional Guardian if needed.
3. Accommodations
Room-Sharing and Property
We encourage room-sharing to maximize bed space. We cannot guarantee same sex rooms, due to the dormitory style of the bed and breakfast as the rooms are a king or queen bed with a twin in the same room.Independent, solo travelers, friends or couples could be room sharing.We will do our best to match people together due to gender, age and similar backgrounds, but we cannot guarantee it.
The customer shall not use the property except for permitted use and shall not use the property for any offensive, noisy, dangerous, illegal, entertainment, immoral or improper purposes. The customer shall not do anything which may be a nuisance or annoyance to Sparkle By Design, LLC, retreat and its guests, staff or owners.
The customer shall keep all Sparkle By Design, LLC and Maui B & B retreat fixtures, fittings, furniture and effects in a clean and good condition and shall replace any articles which are destroyed or missing with articles of a similar kind and of equal value.
In the event that the customer decides to downgrade their accommodation after monies have been paid, the customer will not be entitled to any refund. If the customer wishes to upgrade, the new price will apply.
4. Your Travel Arrangements
All travel arrangements are your responsibility and at you own cost. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. Transfers to/from the retreat are at your own cost, unless otherwise specified.Sparkle By Design, LLC retreat is not held liable for flight costs.Due to teacher cancellations or other situations beyond our control, Sparkle By Design, LLC retreat reserves the right to change bookings and shall inform the customer as soon as possible. Alternative arrangements will be offered but we do not accept responsibility for any costs incurred, including airfare.
Sparkle By Design, LLC retreat can accept no responsibility for delay or cancellation of any flights, train, buses or other forms of transport.
5.0 Travel Insurance
(a) We require that your travel insurance covers the activity of this retreat as well as unexpected cancellation, sickness, losses and all the usual risks. You should bring the policy with you in case of an emergency. If you do not get Travel Insurance, it is at your own risk.

5.1 Your Health
(a) If you have a medical condition, serious or otherwise, you MUST inform Sparkle By Design, LLC at the time of booking and provide a letter from your Doctor confirming that it is safe for you to attend a with our advertised diet, yoga & meditation classes & and other physical activities that we arrange at your request or are a part of the retreat (e.g. swimming, snorkeling, surfing, hill walking, biking, boating, massage, etc.). In the interests of your wellbeing we may decline your stay at Sparkle By Design, LLC retreat.
(b) If an emergency arises we will do everything in our power to assist you but Sparkle By Design is not responsible for the outcome of any such emergency.
(c) Whilst all measures are taken to ensure a high standard of health and safety, we are situated in the countryside where the land is uneven and we shall not be responsible for any injuries caused by uneven terrain.
(d) Pregnancy: Unless you have been a regular yoga practitioner for several years it is not advisable to practice yoga during the first trimester, particularly if there is any history of miscarriage. During the remainder of pregnancy it is more suitable to attend pregnancy yoga classes. However, if you have been a regular yoga practitioner for several years and your internal muscles are used to yoga postures and if you have a letter from your doctor stating that it is safe for you to engage in the activities that we provide, then you can attend a Sparkle By Design retreat during your second and third trimester. Guidance from our yoga teacher must be observed.
5.2 Animals
No Animals are allowed except a Psychiatric or Physical Service Dog trained to help people with Disabilities or Special Needs.If this is the case, we will need to see the approved paperwork from your doctor and current service dog paperwork as well.If you have Mental or Physical Disabilities or Special Needs, we will need in writing from your Doctor that it is approved for you to attend this retreat with all its differing activities.We are not liable for you or your service dog at any time, and you are responsible for your animal and yourself at all times.
5.3 Pool, Weight/Yoga Equipment and Outdoor Shower
Use the pool with care and you are at your own risk when using the pool, weight/yoga equipment and outdoor shower.
6. Cancellation by You
You (or any member of your party) may cancel your booking at any time, providing that the cancellation is made by the person submitting the booking form and is notified to us in writing. Cancellation will take effect the day such notification is received by us. In addition, if such cancellation is made after 7 Days of your On-line Purchase, we will retain 100% of the cost of the retreat. However, if another person can be found to take your place, then we may offer you a 50% or lesser amount refund, at our discretion. Refunds and returned payments are normally settled within 5-10 working days of the date of cancellation. Otherwise, once a booking has been accepted no payment is refundable unless the course is cancelled. Once the retreat has begun, no refund or part refund or unused portion of the retreat will be repaid in the event of cancellation by you. Bookings are for the stated period of the retreat. There are no refunds for an unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to make a claim.

7. Amendments by Sparkle By Design, LLC Retreats
Occasionally, changes may have to be made (e.g., yoga teacher, class times or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed for any reason, we will do our utmost to provide accommodation of a similar rating. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure.

8. Cancellation by Sparkle By Design, LLC Retreats
We reserve the right in any circumstances to cancel a retreat, in which case we will offer a full refund of all monies paid within 10 working days. In particular our retreats require a minimum number of at least 50% of the participants to have booked by 7 days before the start date. If this minimum number is not reached by that date we may cancel and refund the money to you.

9. Our Liability to You
(a) We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.
(b) We do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, “Acts of God”, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.
(c) We are not liable for any injuries you may incur during any activity during the retreat. Yoga and Meditation Classes along with all Activities are undertaken at your own risk. We are not liable for any medical or psychiatric conditions which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property.
(d) We are not responsible for the proportion of male/female guests in any group. We are not responsible for the individual behavior of any guest.
(e) We reserve the right to ask you to leave the premises at our discretion if your behavior is disruptive or abusive. With this, no refund will be given to you or parties with you.
10. Group Bookings
Where a booking is made on behalf of several individuals the booking is conditional on the person signing the booking form having authorization from all the individuals named on the booking form to enter into this contract. A deposit from every group member is required. If any member of the group cannot come for any reason, their deposit is forfeit.

11. Additional conditions for Yoga and Meditation Retreats
Booking: In order to be accepted on our Yoga and Meditation retreat and you have any medical conditions that weakens you, we request that you complete and return a health questionnaire. T his will be sent to you by email.
Contradictions: A Yoga and Meditation retreat may not be appropriate if you are currently being treated for cancer, or receiving chemotherapy or radiotherapy, or undergoing treatment for a life threatening illness, or if you are an insulin dependent diabetic, or of you have heart problems, or high blood pressure. A Yoga and Meditation retreat may not be suitable if you are pregnant or breast feeding. Anyone with chronic illness should consult with their registered health practitioner before attending. In certain cases, we may ask for a letter from your health practitioner to confirm that you are well enough to participate in the retreat.If you attend the retreat with any of these items listed above, or have other life threatening or physical/mental illnesses or weaknesses that could compromise your health in any way, you are doing it at your own risk and Sparkle By Design, LLC is not in any way liable.

12. Complaints
Fortunately we have not ever had one, if you have a problem during your retreat, please inform the owner or manager immediately and he/she will endeavor to put things right. If he/she cannot rectify the matter, it is up to you to raise the issue with that party or get advice from a professional that can assist you. Any retrospective complaint must be made in writing to Sparkle By Design, LLC within 7 Days of the end of your retreat.We cannot guarantee any resolve or solution do to potential differing perspectives to each situation that could arise. We are not liable or responsible to rectify any complaints or disputes at Sparkle By Design, LLC retreat.

13. Legal Disclaimer

15. Use of Mobile Phones and WiFi Devices
Mobile phones and other WiFi devices may not be used during retreat classes and activities unless you leave the immediate area to not disturb the participants, teachers and staff, except in your room. Retreats are designed for people to be quiet and reflective. Please be discrete when talking on your phone. Listening to music on headphones is permitted at a kind and moderate volume, so as not to disturb other guests.
16. Sparkle By Design, LLC retreat reserves the right to alter any facility accommodations, yoga and meditation activity, event activity, etc. at any time.
17. Sparkle By Design, LLC retreat retains all copyright license rights and sole exclusive ownership of the information, photographs and material displayed on its website. The material may not be modified, copied or used in any other way.
Any user of the website has to be 18 years of age or older and agrees to be entirely financially responsible for all charges and other fees arising from use of the website.
Sparkle By Design, LLC accepts no responsibility for keeping the website up to date and will not be liable for any loss by its failure to do so. We are not responsible for the contents of any links displayed on our website.
18. Sparkle By Design, LLC retreat can use any information, photographs, videos, recordings, etc. that happen during the event.You are agreeing to allow us to photograph, video tape or record you during the retreat and allowing us to use this information for the website, advertising, marketing or otherwise, at our own disposal.
19. Sparkle By Design, LLC retreat cannot accept any responsibility for loss or damage of personal possessions or valuables of the customer.
20. Sparkle By Design, LLC retreat shall not be liable for any failures beyond its control. This covers natural disasters, war, ‘acts of God’, closure of airports, civil strife, accidents or failure to perform by third parties, including suppliers and subcontractors.
21. Sparkle By Design, LLC retreat accepts no liability for loss, damage, injury or illnesses which may be received during the customers stay or travelling to and from Sparkle By Design, LLC and Maui B & B.
22. What we collect:

We may collect the following information: * name and job title * contact information including email address * demographic information such as postcode, preferences and interests * other information relevant to customer surveys and/or offers

The Information We DONT Collect:
Credit/Debit Card Information – all payments are processed through PayPal, or our Merchant Bank who ensure your banking details are never viewed by us.

23. Passports, visas and health requirements
It is the responsibility of all passengers, according to the type of passport you have, check with the consulate where the application for tourist visa is required. Due to visa regulations and health requirements it can change frequently, it is recommended that you check as soon as possible whether the application for tourist visas or health requirements is necessary. Sparkle By Design, LLC retreat is not responsible if you or another passenger is traveling without proper health documentation and the correct passport or visa. In this case you should pay the costs of assistance to solve these problems. In addition you must make full payment of your yoga retreat, without receiving any refund or compensation from Lucia Yoga.
24. Sparkle By Design, LLC retreat is not responsible for any physical or psychological injury that you may have. You are responsible for the possible risks that you may have during a yoga lesson. We are not responsible for any medical or psychological condition that you can develop during the yoga retreat. We are not responsible for loss, damage or theft of personal belongings.
If you feel any discomfort, pain or injury during any of the activities of the yoga retreat, the activity must stop as soon as possible and you must contact a member of Sparkle By Design, LLC retreat. If you continue with the removal activities there are chances of further worsening of the injury, Sparkle By Design, LLC retreat reserves the right to deny your stay and participation in the yoga retreat, without returning the money.
25. Sparkle By Design, LLC retreat is responsible for ensuring that the yoga retreats we advertised on the website have the same service than the yoga retreat you pay for, and these services offered will be carried out under a standard of reasonable quality.
